You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately at hello@surgeseats.com if you become aware of any unauthorized use of your account. Surge Seats is not liable for any losses resulting from unauthorized use of your account.
You may delete your account at any time through the App settings or by contacting us. We reserve the right to suspend or terminate your account if you violate these Terms or engage in behavior that we determine is harmful to other users or the Services.
You agree to use the Services only for lawful purposes and in accordance with these Terms. You agree not to:
Surge Seats does not sell tickets. We provide price comparison information and links to third-party ticket platforms. When you click a "Buy" button in our App, you will be redirected to the relevant ticket platform to complete your purchase.
Any ticket purchase you make through a third-party platform is subject to that platform's own terms of service, privacy policy, refund policy, and other policies. Surge Seats has no control over and assumes no responsibility for the content, policies, or practices of any third-party platforms.
Surge Seats aggregates ticket pricing data in real time. However, ticket prices and availability can change rapidly. We do not guarantee the accuracy, completeness, or timeliness of pricing information displayed in our App. The price displayed on Surge Seats may differ from the price at checkout on the ticket platform due to timing differences, availability changes, or additional fees.
Surge Seats participates in affiliate programs with ticket platforms. We may earn a commission when you click through to a ticket platform and complete a purchase. This commission is paid by the ticket platform and does not affect the price you pay for tickets. We disclose this relationship in the interest of transparency.
Surge Seats provides AI-powered price predictions and Buy Now / Wait / Watch recommendations based on historical price data and trends. These predictions are provided for informational purposes only and do not constitute financial advice or a guarantee of future ticket prices.
Ticket prices are highly volatile and are affected by many factors including event popularity, time until the event, market demand, and platform-specific algorithms. Surge Seats makes no guarantee that following our recommendations will result in lower prices or savings.
You assume all risk associated with ticket purchasing decisions made based on information provided by Surge Seats.
The Services and all content, features, and functionality — including but not limited to the Surge Seats name, logo, design, text, graphics, software, and code — are owned by Surge Seats LLC and are protected by United States and international intellectual property laws.
We grant you a limited, non-exclusive, non-transferable, revocable license to use the Services for your personal, non-commercial use. This license does not include the right to scrape, reproduce, distribute, modify, or create derivative works from our content.
If you provide us with feedback, suggestions, or ideas about the Services, you grant us a non-exclusive, royalty-free, perpetual license to use that feedback in any way we choose without any obligation to you.
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, SURGE SEATS DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

IN NO EVENT SHALL SURGE SEATS'S TOTAL LIABILITY TO YOU EXCEED THE GREATER OF $100 OR THE AMOUNT YOU PAID TO SURGE SEATS IN THE 12 MONTHS PRECEDING THE CLAIM.
You agree to defend, indemnify, and hold harmless Surge Seats LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Services.
These Terms shall be governed by and construed in accordance with the laws of the State of Georgia, United States, without regard to its conflict of law provisions.
Any dispute arising from these Terms or your use of the Services shall first be attempted to be resolved through informal negotiation. If informal resolution is not possible within 30 days, disputes shall be resolved through binding arbitration in Atlanta, Georgia, under the rules of the American Arbitration Association.
You waive any right to participate in a class action lawsuit or class-wide arbitration.
We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page with a new "Last Updated" date, and by sending a notification through the App or by email.
Your continued use of the Services after any changes constitutes your acceptance of the new Terms. If you do not agree to the modified Terms, you must stop using the Services.
If you download the Surge Seats App from the Apple App Store, you acknowledge that these Terms are between you and Surge Seats LLC only, and not Apple Inc. Apple has no obligation to provide any maintenance or support services for the App. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any). Apple has no other warranty obligations. Apple is not responsible for addressing any claims by you or any third party relating to the App.
If you download the Surge Seats App from the Google Play Store, your use is also subject to Google's Terms of Service. In the event of any conflict between these Terms and Google's terms, these Terms shall govern your relationship with Surge Seats.
